1. Scope of Validity
These General Terms and Conditions (GTC) apply to the scope of operations of Airport Taxi Zürich Kloten AG domiciled at Dorfstrasse 60, 8302 Kloten, Switzerland. Airport Taxi Zürich Kloten AG owns and operates both a website and the “Airport Taxi Zürich” app, through which it provides paid rides for customers.
These GTC apply to the above-referenced areas, as well as any further services which Airport Taxi Zürich Kloten AG provides to the customer, either directly or indirectly.
2. Agreeing upon the GTC
By accessing the “Airport Taxi Zürich” app or by registering and using the app, as well as the website, the customer accepts the validity of these GTC. Therefore, the customer is asked to read the General Terms and Conditions carefully before using these platforms.
3. Amendment of the T&Cs
Airport Taxi Zürich Kloten AG reserves the right to amend these GTC at any time. Such amendments will be published here, and then they shall become an integral part of the agreement, if the customer accepts this amendment. A message sent by Airport Taxi Zürich Kloten AG to the customer’s e-mail address shall be sufficient for this purpose. If the customer does not object within four weeks, the customer’s consent will be deemed granted. The respective General Terms and Conditions which are in force as at the time the ride is ordered shall apply to the use by the customer.
4. Conclusion of the Agreement
This agreement is concluded upon acceptance of the use of the “Airport Taxi Zürich” app. Furthermore, this agreement is concluded, if the customer uses the services offered by Airport Taxi Zürich Kloten AG or the customer purchases or uses its products.
5. Payment for services
Unless otherwise agreed, all prices are in Swiss Francs (CHF) and inclusive of value-added-tax (VAT). The prices are determined by the official taxi tariffs of the City of Kloten.
The customer must pay with the payment method stored in the app or in cash in the taxi, by credit card, Maestro card or by using any other available payment methods. Airport Taxi Zürich Kloten AG reserves the right to require advance payment at any time without giving reasons.
Airport Taxi Zürich Kloten AG may, at its own discretion, grant vouchers or discounts. By accepting the GTC, the customer agrees not to duplicate, sell or transfer said vouchers and discounts or make them publicly available in any way, without the express consent of Airport Taxi Zürich Kloten AG.
Airport Taxi Zürich Kloten AG reserves the right to demand back any vouchers or discounts or deduct them from the customer’s account if said vouchers are redeemed or discounts are based on a violation of the valid T&C or an unlawful act or on fraud.
6. Guarantee
Airport Taxi Zürich Kloten AG endeavours to make the app and the website available as much as possible, and protect the latter from any interference by third parties. The availability of “Lucky Rides” with return trips to Zurich Airport at a discount cannot be one hundred per cent guaranteed. If a large number of passengers is at Zurich Airport, Airport Taxi Zürich Kloten AG reserves the right to disable the feature for a certain period of time.
7. Liability
The customer undertakes to use the “Airport Taxi Zürich” app and the website in such a way that no impairments, undue overloads or damages occur and the purpose pursued with said applications is neither put at risk nor bypassed.
In addition, the customer is solely responsible for the information stored in his or her app profile, such as user names, passwords and personal details, and undertakes to keep them safe and confidential. Airport Taxi Zürich Kloten AG shall only be liable to the extent that the cause of the damage is based on wilful or grossly negligent breach of duty, and only up to the amount of the respective price of the journey.
Any liability for any indirect losses and consequential damages is fully excluded. In the case of direct damage, Airport Taxi Zürich Kloten AG’s liability shall be limited to the amount of the price of the journey, unless said direct damage was caused by gross negligence or wilful intent.
The customer undertakes to notify Airport Taxi Zürich Kloten AG of any damage or defects without delay.
Any liability for third parties is excluded entirely.
Exclusively Swiss law shall apply. The place of jurisdiction shall be Zurich.
8. Intellectual Property Rights
All rights in the products and services, as well as any trademarks, are the property of Airport Taxi Zürich Kloten AG. The word and device mark “Airport Taxi Zürich” is a registered trademark. Any data material is copyright-protected, and any unauthorised duplication is prohibited.
Should the customer use content, texts or graphic material in which third parties have an intellectual property right in connection with the company, the customer shall be required to ensure that such intellectual property rights are not infringed.
9. Privacy Policy
The company only uses and processes personal data to the extent that the latter is legitimate and permitted under the Swiss Federal Data Protection Act. The data is used to the extent that it is necessary in order to provide the services, for the use and operation of the services offered on the website and in the app. Personal data is not passed on to third parties, and is only used for internal purposes.

11. Severability Clause
If one or more provisions of these General Terms and Conditions is or becomes invalid, it does not affect the validity and enforceability of the remaining provisions. Airport Taxi Zürich Kloten AG undertakes, in such a case, to substitute the invalid provision by a legally valid substitute provision, which comes closest to the economic intentions expressed by the original provision.
